Booking Terms and Conditions

1. GENERAL
The booking terms and conditions form the sole contract between the owners Eileen M Smith and Mark Cox (referred to as us/we) and the person signing the booking form, who must be over 21 years of age and who shall be deemed to sign the booking form on behalf of all the persons herein.

2. BOOKINGS
2.1 Provisional confirmation of availability and rates
Upon receipt of a request for availability, the property rates and the amount of deposit required will be advised. Property rental rates are quoted on a daily basis in US Dollars and include daily maid service, gardening and pool services, electricity, gas and water. The villa is fully equipped with linen, towels, crockery, utensils and an initial supply of soap and toiletries.
2.2 Exclusions and additional charges
The rates quoted do not include baggage handling, gratuities, telephone charges, vehicle rental, food and beverage, personal items and other expenses. Any excessive cleaning, excessive use of air conditioning, damage to fixtures and fittings or replacement of breakages. Fair wear and tear accepted.
2.3 Initial deposit
A completed booking form and an initial deposit of 35% of the total charge is required to confirm a booking. For bookings of less than 1 week (4-6 nights) or for bookings made within 60 days of arrival, full payment is due at the time of the booking.

3. PAYMENT
3.1 Method of payment
We accept payment by bank transfer, UK cheque or by credit card (a transaction fee is applied to all credit card transactions).
We will not be held liable for any credit/debit card charge backs made against us.
3.2 Payment due date
Payment of the outstanding balance must be received at least 60 days prior to arrival. If we do not receive the balance by the due date, we reserve the right to cancel the booking and cancellation charges will apply. For bookings of less than one week (4-6 nights) or for bookings made within 60 days of arrival, full payments is due at the time of the booking.

4. CANCELLATION AND AMENDMENTS
4.1 Cancellation
You may cancel your reservation at any time by notifying us by email. In the event of cancellation or if we cancel the booking due to non-payment of the balance by the specified date the following cancellation charge shall apply.
Between the booking date and 60 days prior to arrival - Deposit charge
Between 60 days prior to arrival and the arrival date - Full payment charged
4.2 Amendments
Requests for any amendment must be advised in writing.

5. ARRIVAL AND DEPARTURE TIMES
Check in time is 3:00 pm and the check out time is 12:00 noon.
We will arrange for our representative to collect you from the airport on arrival and return you to the airport at the end of your holiday. If we are required to make more than one journey each way due to different flight arrival/departure times an additional charge will be levied.
Consideration is given where possible for early flight arrival and late departure times.

6. ALTERATIONS OR CANCELLATION BY US
In the unlikely event that we have to make any changes to confirmed bookings you will be advised by email at the earliest possible date.
If the property is damaged or rendered unusable, or if for any reason beyond our control or due to unexpected circumstances we are unable to provide you with the property we will endeavour to provide an alternative property for the duration. If this is not possible, or you do not wish to accept the alternative property offered you will be refunded in full (less any bank charges or credit card transaction fees)
We shall not be liable for any further obligations or claims whatsoever.

7. REGISTERED GUESTS
Only those persons stipulated on the booking form may reside at the property as guests. Please notify us of any changes you wish to make. The number of people staying at the property including children, must not exceed six, except in the case of infants under two years old, or unless specifically authorised by us in writing.
Should our property manager find that the number of people staying at the property exceeds that on the booking form, the additional guest(s) will be subject to a per night surcharge or asked to vacate the property forthwith.
No camping permitted in the grounds of the property and no pets allowed.
Smoking is not allowed inside the property, though it is permitted outside on the terrace. Your co-operation is therefore requested and appreciated.
The person signing the booking form is responsible for the conduct and appropriate behaviour of all guests residing at the property. Should any guest(s) not behave in an appropriate manner our property manager has the absolute discretion to ask the offending guest(s) to vacate the property forthwith.
It is absolutely prohibited for guests to allow prostitutes, illegal or immoral activities within the private boundaries of the property.

8. INSURANCE
It is a condition of booking that all guests are covered by comprehensive travel insurance including, but not limited to cancellation/curtailment, medical emergency, repatriation and associated expenses, loss of, and damage to personal property and belongings, third party liability, locally procured third party services including, but not limited to watercraft, water sports and vehicle rental.
We strongly recommend this be arranged once your reservation is confirmed.

9. LIABILITY RELEASE
We accept no responsibility or liability for death, personal injury, sickness, accident, delay, loss of luggage or any other loss or misadventure. We accept no responsibility or liability for any loss or damage or alteration in the terms of the booking caused by events beyond our control, including but not restricted to war, terrorist activity, civil commotion, flight delays or cancellation, airport closure, adverse weather conditions, fire, flood and industrial dispute.
We accept no responsibility or liability for the failure of public services, such as electricity or water supply. Nor for the consequences of the actions or omissions of persons who may supply or control main services, or any actions taken in the vicinity of the property reserved, by any authority or persons over which we have no control. We cannot accept any liability for the failure of the air-conditioning, broadband connection, pool filtration system or any household appliance. Urgent steps will be taken for a local engineer to rectify any problem.
We accept no responsibility or liability for your personal safety. Use of the property amenities including the pool is entirely at your own risk.

10. LINENS AND TOWELS
Linens and towels are provided and are changed on a regular basis. Outside laundry services are available for a small charge and must be paid for at the time

11. COMPLAINTS
The property described in this website is provided in good faith and we accept no liability for any errors or omissions.
Should you experience any problems whatsoever with the villa during your stay that cannot be rectified by our property manager, please contact us, and will do our best to assist and rectify the matter as soon as practically possible. We cannot resolve a problem for you unless we are notified at the time. Please give us the opportunity to correct matters. Should a problem remain unresolved you are asked to notify us in writing within 7 days of vacating the property. No action can be taken or liability accepted for any complaints received after this period. We aim to resolve complaints within a reasonable period of time, the details of which will be kept confidential to only the parties involved.

12. APPLICABLE LAW
These conditions and any contract to which they apply are governed in all respects by Thai Law and the Thai Law Courts only shall have sole jurisdiction in relation to any claim or dispute arising out of or connected with them.
